Terms and Conditions

  1. General
    1. These Terms and Conditions (“T&Cs”) apply to all donations made by you (“you”) through an online giving platform on the https://doula.ie website (“Platform”) operated by The Doula Association of Ireland (“we” or “us”) and govern your use of the Platform, including any other functionality provided on our website that permits you to make donations, unless stipulated differently in a specific written agreement.
    2. By using the Platform, you specifically agree with the applicability and content of these T&Cs and undertake to respect them. By making a payment you acknowledge and agree that you have the legal capacity to use our services and make payment online. If you are accepting these T&Cs on behalf of an entity, you acknowledge and agree that you have the legal mandate to accept them on behalf of such entity.
    3. We reserve the right to update these T&Cs from time to time by posting relevant changes on our Platform “https://doula.ie”, following which all the terms of a new version will apply. It is your responsibility to review these T&Cs regularly. We also reserve the right to modify the functionalities of the Platform. You agree that platform will not be liable to you or any third party for any such action.
    4. Should any specific clause included in these T&C’s be found to be invalid or non-applicable, the other provisions of the T&C’s will remain in full force and effect.
  2. Description and definitions
    1. DAI” shall mean Doula Association of Ireland.
    2.  “Donor” refers to you and/or any other individuals or organizations wishing to make a donation online.
    3. Donation” is a unilateral philanthropic contribution that may or may not be tax-deductible.
  3. Donations
    1. To use our service, you will need to follow the procedures set out on our Platform and provide all required information.
    2. You may choose a payment method to make your donation. You agree and acknowledge that we work with a third-party payment provider who will process your payment subject to their own terms and conditions.
    3. You agree that all details that you provide to us for the purpose of using the Platform are correct, that you are entitled to the means of payment and there are sufficient funds to cover a donation.
    4. We (or our payment provider) reserve the right to verify the authenticity of your payment methods before taking further steps in processing your donation. We are also entitled to refuse your donation.
  4. Use of Platform
    1. You agree to provide all necessary information on an online donation form. You acknowledge and agree that required information can vary from country to country depending on which information is required by national law to issue a valid tax receipt to the donor.
    2. We undertake to provide our service with reasonable skill and care and ensure its availability but cannot guarantee that it will operate without interruptions and do not accept any liability for its unavailability.
    3. We will do everything we reasonably can to guarantee secure access to the service. We work with a third party hosting a platform in EU data centres which uses encryption technologies and other practices to ensure security appropriate to the risk. However, you acknowledge that we cannot be held responsible for any losses attributable to the fact that you have not taken reasonable precautions to prevent interception or ensure anti-virus protection on your own computer, or losses arising from fraudulent or unauthorized use of your payment method which are not attributable to insufficient security of our Platform.
    4. The contents of our website are protected by international copyright laws and other intellectual property rights.
    5. We will not publish your identity.
    6. The DAI try to provide the latest and most complete information possible. Amendments to the provided information provided may be made at any time, please consult our website regularly for the most updated version. Please note that all materials and content are provided to you on an ‘as is’ basis and you are solely responsible for your use of our website and use of all information contained within it.
    7. Our Platform may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for any other websites that you may access through our Platform or which may link to our Platform. We have no control over any such external party’s website and accept no responsibility for the content or the use of these websites and we shall not be liable for any damages or losses caused in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
  5. Limitations of Liability
    1. We cannot be held responsible for any delay in performing or failure to perform its obligations under the present T&C’s if such delay or failure results from:
      • If the service is not used properly;
      • If the user has not fulfilled their obligations;
      • In the event of force majeure including events, circumstances and cases beyond our reasonable control.
    2. Any outages or interruptions to the Platform leading to the temporary inability to view or use it, do not ensue in an entitlement to compensation.
    3. Under no circumstances will the DAI be held responsible for indirect damages such as loss of data, revenue or business, whether foreseeable or not.
    4. Nothing in these T&Cs shall have the effect of limiting or excluding any liabilities in any way that is not permitted under applicable law.
    5. If we are liable to you for any reason, our liability will be limited to the amount of any donation you have made using our services.
    6. The exclusions of liability provided for in this clause 5 also apply to the liability of our employees, agents, advisers and representatives.

    1. By using our platform, you agree that your personal data will be processed for the purposes and in accordance with the procedures described in our Privacy Statement https://www.doula.ie/privacy-statement.
    2. We would like to remind you that the privacy policies of third parties (eg, payment provider) may be applicable too.
  7. Governing Law
    1. Any dispute or difference of opinion relating to these T&Cs will be subject to Irish law and the exclusive jurisdiction of the commercial courts of Dublin.
